The Mental Capacity Act Northern Ireland gives exactly the same legal framework for the non-consensual medical treatment of all citizens no matter what their illness.
The Act aims to safeguard the rights of the people with mental illness, along with access to healthcare and treatment without discrimination from the government.
Duties Act. The objects of the Act clearly distinguish between improving and maintaining the health and wellbeing of persons who do not have capacity to consent to.
The Act provides for the involuntary assessment and treatment, and the protection, of persons with mental illness. At the same time, the Act aims.
The equivalent law for physical illness, the Mental Capacity Actonly applies if the person cannot consent because they lack capacity to do so.
